American Disabilities Act
Introduction
The Americans with Disabilities Act (ADA) was passed in 1990 in response to the
political activism of numerous individuals and organizations who lobbied for the rights of persons with disabilities to participate fully in society. ... The goals of the ADA, as stated in its preamble, are to ensure equality of opportunity for persons with disabilities, promote their economic self-sufficiency, encourage independent living, and otherwise assure the full participation of persons with disabilities in society.
Title I of the Act is directed at the problems workers with disabilities encounter in the
labor market. It prohibits employers from discriminating against “otherwise qualified” workers with disabilities, who are able to perform the essential functions of a job “with or without reasonable accommodation. ... The ADA was one of the major policy changes of the 1990s, but workers with disabilities have received relatively little attention in the labor market literature, and researchers have a limited understanding of wage and employment differences between disabled and nondisabled workers. ... Finally, in addition to data problems, relatively little is known about workers with disabilities because labor market access for this group has only recently become a policy concern. ... Studies show that workers with disabilities earn significantly lower wages than do nondisabled workers and the differential appears to have increased for males over the period from 1990 to 1993.
