This case represents AIDS issue of one of the NET Associates-Paul Cronan. ... The “key issues” in this case, in my opinion is lack of company’s top management direct involvement from the start of the problem, lack of HR support, lack of proper training and awareness program which should have been provided to all employees. “Is it legal for any company to neglect potential “biohazard” like exposure to AIDS and not providing any training or awareness program to its employees?” Then, if this is the legal question, we may also ask, “What tells any company to cover all aspects of potential disaster happening at workplace? ... Additionally, legal and main question could be “Is it legal for any company to disclose personal and medical employee information without employee’s knowledge and both parties consensus?” Finally, I recognize the last presented question as the most important legal question, where the first two questions could be considered sub-questions that were evolved from main question regarding personal information and medical status disclosure of an associate.
