Can the hospital actually harvest the organ of an unclaimed body of a dead person?
To answer this question, firstly we have to look at how would the hospital handle the cases of unclaimed bodies. For unclaimed bodies, there is no specific provision in any of our statutes or law about how to handle unclaimed bodies. However, section 4 of the Human Tissue Act (HTA) 1974 did mentioned that it is based on the discretion of the Director of Hospital on what to do with unclaimed bodies. For section 4 of HTA states that, for unclaimed bodies in the hospital, the person who shall be in the possession of the body is the hospital.
The way of handling of unclaimed bodies usually is based on the religion of the deceased. This, the hospital shall be of the duty to determine the religion of the bodies based on physical check on the face features, body marks e. ...
In the case of Non-Muslim bodies, the same reasonable announcements through radio, television or other medias shall be made.
