In Fadiman’s book, The Spirit Catches You and You Fall Down tells about the early life story about a Hmong child, Lia, and her family in the United States who is diagnoses with epilepsy. ... In this essay, I am going to identify an ethical problem for nursing that is illustrated in this story and identify ethical principles that are in conflict. Next, I will take a stance on an ethical principle to prevent the problem from occurring in my own practice and discuss implementation and obstacles of the planned action. The purpose of this essay is to demonstrate that cultural barriers can lead to ethical problems.
The ethical problem that I am going to focus on in the story by Fadiman is about Lia’s parents not giving her medication and the action that the medical team took by taking Lia away from her parents for their non-compliance. ... Consequently, due to American culture, the court system rules beneficence over autonomy when a minor is involved (Fadiman, 1998, p 80). ... For example, on the response to the eight questions, the parents thought that she should stop taking the medicine after she is well, she should be treated with Hmong medicines, and they didn’t think for sure that she should stop shaking because she may become a shaman (Fadiman 1998, p 260).
