Governor Kenny Guinn sued the Legislature for failing to do its job, which is to balance the budget and to fund the schools. As a result, the petition filed by Attorney General Brian Sandoval asks for the Supreme Court to order the Legislature to pass budget. Basically, the Governor is merely asking the Legislature to fulfill their Constitutional duty. This Constitutional duty refers to Article 9 (section 2) and Article 11 (section 6) of the Nevada Constitution. In the petition, the Governor gives a number of reasons why the Supreme Court should compel the Legislature to pass a budget. To start, the Governor discusses the violation of the Nevada Constitution by the Legislature. He points out in the petition that, as a Governor of the state, he has a duty to ensure that all laws are carried out in accordance with the Nevada Constitution. In that sense, failure to comply with the state law is unacceptable and that the Governor is not doing his duty defined by the Nevada Constitution. Second, he brings up a similar court case that took place in Washington, where the court favored the protection of the Constitutional duty.
