Brumbaugh 355 So. 2nd 1186 (1978) Florida Supreme Court JUDICIAL HISTORY : The Florida Bar, petitioner/plaintiff, charged Marilyn Brumbaugh, respondent/defendant, with engaging in the unauthorized practice of law and sought a permanent injunction prohibiting the respondent from further engaging in such allegedly unlawful acts, in the Florida Supreme Court. FACTS: The Respondent in this case is Marilyn Brumbaugh, who owned “Marilyn’s Secretarial Service. She is not an attorney, nor did she claim to be an attorney to her customers. She performed “Do-It-Yourself” divorces, wills, resumes and bankruptcies. Respondent provided services to customers by preparing dissolution of marriage documents. A referee was appointed by the Florida Bar to investigate the matter. The referee found that Respondent prepared, for a fee, all papers deemed by her to be needed for the pleadings, filings, and securing of a dissolution of marriage, as well as detailed instructions as to how the suit should be filed, notice served, hearings set, trial conducted, and the final decree secured.
