A defamation action is the legal claim that an individual can bring to protect his or her reputation . There is no single comprehensive definition of what is defamatory. However, the most comprehensive definition is used by the American Law Institution , which is: “a statement is defamantory if it tends to harm the reputation of another so as to lower him or her in the estimation of the community or to deter third parties from associating or dealing with him or her.” For a plaintiff to bring a legal action forward in regards to a defamation imputation, the following criteria has to be established: • It has to be published to a third person • It must identifies the plaintiff • It must contain a defamatory statement or imputation A defamation imputation can take many forms, however it is usually conveyed in words, which is either written (also known as ‘libel’) or spoken (also known as ‘slander’).
