As a rule, laws develop in response to what has occurred in the past, not what will be possible in the future and it is this resulting lag in the law that justifiably draws criticism. The Consumer Credit Code is an example of new law with which we are all familiar which is desperately lacking in forward thinking. Who would have thought that a 1996 Statute that would have universal application to retail financial service providers would make provision for service of notices by "telex" and not mention "E-mail".
