KaZaa: Legal or Illegal? When downloading music from the internet, have you ever thought that you may be breaking the law? Most people do not think about it, but if you are using a program to download songs for free, you are committing a felony. File sharing, also known as peer-to-peer sharing, over the internet is illegal in some instances. Some of these instances are the sharing of music, video clips, movies, etc. Most people use programs to download these files for free, however, the files are copyrighted, and this is considered illegal. If this "peer-to-peer" sharing is illegal, than who is to blame? Should the people who are doing the sharing get sued or should the program that is allowing the sharing be sued and shut down? Peer-to-peer, also known as P2P, sharing is a type of file-sharing network that allows users with the same networking software to access the contents of a specified area on each other's hard drives. The way peer-to-peer sharing works begins by installing networking software onto a user’s computer. Then that user is able to call or log into the computer of another user currently on the file sharing network. Specific files can then be shared within both users’ specified drive and underlying folders. Most of this peer-to-peer sharing is done for free using certain types of software. As stated on Legal-Database.com, "Downloading music, movies, games, or software from the Internet without paying and sharing these materials without appropriate permission is considered a breach of copyright laws." Also on the page, it states, "When your music is under the custody of a music-sharing program, anyone can access it and download a copy. This makes you a distributor of copyrighted materials." Some examples of music-sharing programs are Splooge, Piolet Networks, Music City, and the most used peer-to-peer sharing program, Kazaa. Who would have thought that innocently downloading music from the internet would be such a crime? The question to be answered, however, is are the user’s to blame or the music-sharing program? Kazaa is one of these programs that offers free peer-to-peer downloading of songs, videos, games, and other files on the internet.
